Welcome to LeadSpark AI ("LeadSpark AI", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of the LeadSpark AI web application and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Accounts

You must be at least 18 years old to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

2. Acceptable Use

You agree not to misuse the Service. You are responsible for ensuring that your use of the Service complies with all applicable laws, regulations, and the terms of service of any third-party websites you interact with. Prohibited actions include: (a) attempting to scrape, access, or interfere with our infrastructure; (b) using the Service for any unlawful, harmful, or deceptive purpose; (c) uploading or processing data that you do not have the legal right to use.

3. The Service and Credits

LeadSpark AI is a writing assistant that allows you to provide URLs to publicly available professional profiles. Our system analyzes public information from these sources and uses an AI model to generate personalized sentence suggestions ("icebreakers"). Usage of the Service is measured in credits, where 1 credit is consumed for each profile processed. Credits are allocated based on your subscription plan and do not roll over from month to month. Expired credits are non-refundable.

4. Subscriptions and Payments

We offer monthly and annual subscription plans. Payments are securely handled by our designated payment processor, Polar. By subscribing, you authorize us to charge your payment method on a recurring basis for the subscription fee, plus any applicable taxes, until you cancel. You may cancel your subscription at any time through your account settings.

5. Intellectual Property

The Service, including its software, content, and branding, is the exclusive property of LeadSpark AI. We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal business purposes. You retain full ownership of the data you provide and the icebreakers generated for you.

6. Termination

We reserve the right to suspend or terminate your access to the Service at our discretion, particularly if you breach these Terms. You may cancel your subscription at any time. Upon termination, your right to use the Service ceases, and any unused credits will be forfeited.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THE ACCURACY OF THE DATA ANALYZED OR THE AI-GENERATED OUTPUTS, NOR DO WE GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEADSPARK AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.
